ข้าพเจ้าตกลงและยินยอมทำข้อตกลงเกี่ยวกับการใช้บริการสนามเด็กเล่นในร่มกับ PLAYMONDO GROUP ดังต่อไปนี้
เงื่อนไขการใช้บริการ
คำนิยาม
“PLAYMONDO GROUP” หมายรวมถึง บริษัท เซ็นทรัล การ์เด้น จำกัด ประกอบไปด้วย แบรนด์ Playmondo, Playsquare Laser Tag, CUBS by Playmondo และ Famplayland
“ข้อมูลส่วนบุคคล” หมายถึง ชื่อ นามสกุล อายุ เพศ บัตรประจำตัวประชาชน เบอร์โทรศัพท์ อีเมล ไลน์ไอดี หรือข้อมูลใดอื่นใดก็ตามที่สามารถบ่งบอกตัวบุคคลได้ (ไม่ว่าด้วยข้อมูลนั้นเอง หรือโดยประกอบกับข้อมูลอื่น)
ผู้ใช้บริการรับทราบว่า
• PLAYMONDO GROUP เป็นเพียงผู้ให้บริการสนามเด็กเล่นในร่มแก่ผู้ใช้บริการเท่านั้น ไม่ใช่สถานที่รับฝากหรือรับเลี้ยงเด็ก และไม่ใช่สถานที่รับฝากทรัพย์ จึงไม่มีหน้าที่หรือความรับผิดชอบในการดูแลเด็กที่เข้าใช้บริการ หรือการรักษาทรัพย์สินของผู้ใช้บริการที่นำเข้ามาในสถานที่ของ PLAYMONDO GROUP
• การใช้บริการอาจจะเกิดอุบัติเหตุหรือได้รับอันตรายได้ และยินดียอมรับความเสี่ยงดังกล่าวเอง ผู้ใช้บริการตกลงใช้บริการอย่างมีสติ มีความรับผิดชอบต่อตนเองและผู้อื่น
• กรณีที่ผู้ใช้บริการพาเด็กอายุต่ำกว่า 7 ปี หรือบุคคลที่ไม่สามารถดูแลตัวเองได้มาใช้บริการกับ PLAYMONDO GROUP ผู้ใช้บริการจะเป็นผู้ดูแลและช่วยเหลือบุคคลดังกล่าวตลอดเวลาในระหว่างใช้บริการ
• PLAYMONDO GROUP จัดให้มีประตูกั้นเข้า-ออก และแบ่งพื้นที่เป็นส่วนต่างๆก็เพื่อจัดสรรพื้นที่ให้เป็นสัดส่วนเพื่ออำนวยสะดวกให้กับผู้ใช้บริการเท่านั้น PLAYMONDO GROUP จึงไม่มีหน้าที่หรือความรับผิดชอบกรณีทรัพย์สินของผู้ใช้บริการสูญหายหรือเสียหาย หรือกรณีผู้ใช้บริการที่เป็นเด็กพลัดหลงจากผู้ปกครองหรือผู้ดูแลหรือออกจากสถานที่ของ PLAYMONDO GROUP ไปไม่ว่าด้วยตนเองหรือกับบุคคลใด
• PLAYMONDO GROUP ไม่มีหน้าที่ติดตาม สอดส่อง ตรวจสอบ ดูแลพฤติกรรมการกระทำของผู้ใช้บริการ หรือผู้อื่นที่อยู่ในสถานที่ของ PLAYMONDO GROUP แต่อย่างไรก็ตาม หาก PLAYMONDO GROUP พบเห็นผู้ใช้บริการฝ่าฝืนหรือไม่ปฎิบัติตามกฎระเบียบและคำแนะนำ หรือสุขภาพร่างกายไม่เหมาะสมแก่การใช้บริการก็ดี PLAYMONDO GROUP จะพิจารณายุติหรือยกเลิกการให้บริการแก่ผู้ใช้บริการรายนั้นๆ โดยขอสงวนสิทธิ์ในการเรียกเก็บค่าบริการ หรือไม่คืนค่าบริการ แล้วแต่กรณี
• PLAYMONDO GROUP ไม่มีหน้าที่รับผิดชอบอย่างใดๆทั้งสิ้น กรณีที่เกิดความเสียหายแก่ชีวิต ร่างกาย อนามัย ทรัพย์สินของผู้ใช้บริการ อันเนื่องมาจากผู้ใช้บริการไม่ปฎิบัติตามกฎระเบียบหรือคำแนะนำ หรือเกิดจากความจงใจหรือประมาทเลินเล่อของผู้ใช้บริการหรือผู้อื่น
• ผู้ใช้บริการตกลงปฎิบัติตามกฎระเบียบของ PLAYMONDO GROUP ที่ติดประกาศไว้ ณ สถานที่ของ PLAYMONDO และคำแนะนำของ PLAYMONDO GROUP อย่างเคร่งครัด
• ผู้ใช้บริการตกลงเป็นผู้รับผิดชอบและดูแลเด็กที่เข้าใช้บริการสนามเด็กเล่นในร่มในสถานที่ของ PLAYMONDO GROUP ให้ได้รับความปลอดภัย และตกลงรับผิดชอบในการกระทำใดๆของเด็กซึ่งก่อหรืออาจก่อให้เกิดความเสียหายต่อชีวิต ร่างกาย อนามัย หรือทรัพย์สินของพนักงาน เจ้าหน้าที่ ผู้ใช้บริการท่านอื่น หรือของ PLAYMONDO GROUP ในระหว่างการใช้บริการ
• ผู้ใช้บริการต้องสวมถุงเท้ากันลื่นตลอดเวลาระหว่างใช้บริการ
• ผู้ใช้บริการต้องมีสุขภาพแข็งแรงเหมาะสมแก่การใช้บริการ ไม่มีโรคประจำตัวที่ไม่เหมาะสมต่อการใช้บริการ ไม่เป็นโรคติดต่อ ไม่มีการอาการป่วย ไอ จาม ไข้ มีเสมหะ มีน้ำมูก เป็นหวัด ไข้หวัด รวมถึงโรค/อาการป่วยอื่นๆที่ PLAYMONDO GROUP เห็นว่าไม่เหมาะสมกับการใช้บริการ
• กรณีผู้ใช้บริการได้รับอุบัติเหตุหรือเจ็บป่วยฉุกเฉินในขณะอยู่ในสถานที่ของ PLAYMONDO GROUP ผู้ใช้บริการยินยอมอนุญาตให้ PLAYMONDO GROUP ดำเนินการต่างๆที่เห็นสมควรดังวิญญูชนพึงปฎิบัติและจำเป็นเพื่อช่วยเหลือผู้ใช้บริการ รวมถึงแจ้งโรงพยาบาล หน่วยกู้ภัย เจ้าหน้าที่รัฐ โดยผู้ใช้บริการตกลงชำระค่าใช้จ่ายที่เกิดขึ้นจริงให้แก่ PLAYMONDO GROUP ซึ่งการดำเนินการดังกล่าวไม่ใช่การให้บริการแต่เป็นการดำเนินการเพื่อมนุษยธรรมและช่วยเหลือผู้ใช้บริการ
• ผู้ใช้บริการขอรับรองและยืนยันว่าหลังจากได้ตรวจดูสถานที่ของ PLAYMONDO GROUP แล้ว เด็กที่เข้าใช้บริการมีสุขภาพร่างกายเป็นปกติและมีความพร้อมในการเข้าร่วมหรือเข้าใช้สนามเด็กเล่นในร่มของ PLAYMONDO GROUP โดยผู้ปกครองหรือผู้ดูแลเด็กจะเป็นผู้ดูแล ระมัดระวัง และตรวจสอบความเหมาะสมของการเล่นกับอุปกรณ์หรือเครื่องเล่นในสถานที่ของ PLAYMONDO GROUP
• ข้าพเจ้าตกลงสละสิทธิในการเรียกร้อง การฟ้องร้อง หรือการดำเนินคดีความต่างๆ เพื่อค่าเสียหาย ค่าใช้จ่าย หรือเงินอื่นใด เพื่อชดใช้ความสูญหายหรือเสียหายต่อทรัพย์สิน ร่างกาย ชีวิต หรือความเสียหายใดๆ ต่อข้าพเจ้า ครอบครัว ทายาท หรือผู้รับโอนสิทธิ ซึ่งเหตุเกิดจากการที่ตัวข้าพเจ้าเองหรือเด็กที่อยู่ในการดูแลมาใช้บริการใน PLAYMONDO GROUP และเกิดความสูญหายหรือเสียหายอย่างใดๆ อันเนื่องมาจากความประมาทในการกระทำหรือละเว้นการกระทำของ PLAYMONDO GROUP ซึ่งการสละสิทธิเรียกร้องนี้ให้รวมถึง บริษัทในเครือ กรรมการ ผู้ถือหุ้น พนักงาน ผู้สนับสนุน ตัวแทน คู่ค้า ผู้แทน หรือผู้รับโอนสิทธิจากบุคคลดังกล่าวด้วย
หากผู้ใช้บริการต้องการรับข้อมูลใดๆจาก PLAYMONDO GROUP สามารถติดต่อ PLAYMONDO GROUP ผ่าน LINE, E-mail และ SMS
เพื่อเป็นการปฎิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคล PLAYMONDO GROUP ได้ประกาศนโยบายข้อมูลส่วนบุคคล เพื่อแจ้งให้ผู้ใช้บริการทราบว่า PLAYMONDO GROUP ได้จัดเก็บ ใช้ และเปิดเผยข้อมูลส่วนบุคคลของผู้ใช้บริการ ผู้ใช้บริการจึงตกลงและรับทราบนโยบายข้อมูลส่วนบุคคลของ PLAYMONDO GROUP ที่ประกาศไว้ในเว็บไซต์ของบริษัท https://playmondo.fastorder.today/data/th/PDPA.html
ความยินยอม
ผู้ใช้บริการตกลงยินยอมให้มีการบันทึกภาพและวีดีโอของผู้ใช้บริการขณะอยู่ในสถานที่ของ PLAYMONDO GROUP เพื่อประโยชน์ในการให้บริการ ความปลอดภัย การโฆษณาและการประชาสัมพันธ์
ผู้ใช้บริการยินยอมให้ PLAYMONDO GROUP จัดเก็บ ใช้ และเปิดเผยข้อมูลส่วนบุคคลแก่ผู้ประมวลผลข้อมูลส่วนบุคคลของ PLAYMONDO GROUP เพื่อการโฆษณา การประชาสัมพันธ์ รวมถึงการทำการตลาดที่เกี่ยวกับผลิตภัณฑ์หรือการให้บริการของ PLAYMONDO GROUP

Agreement and Consent for Using a Service at Indoor Playground with PLAYMONDO GROUP
I agree and give consent by entering into this agreement to use the service at indoor playground with PLAYMONDO GROUP under the following conditions:
Using Condition:
Definition
“PLAYMONDO GROUP” means Central Garden Company Limited which consists of Playmondo, Playsquare Laser Tag, CUBS by Playmondo and Famplayland brands.
“Personal Data” means name, last name, age, gender, ID number, phone number, email, Line ID or any other information which can identify a person (whether by such information itself or together with other information).
Customer agree and acknowledge that:
• PLAYMONDO GROUP is a service provider serving for indoor playground purpose only, not for a purpose of nursery or property watch service, therefore, PLAYMONDO GROUP shall not have a responsibility to take care of your child/children who use(s) our facility; or watch belongings of any person(s) who come(s) to use a service at PLAYMODN GROUP.
• To use a service at PLAYMONDO GROUP, there is a chance of accident which may occur to you and/or your child/children. Customer agrees to take and accept the risk and shall use a service prudently and take responsibilities for yourself and others.
• If child/children using a service with PLAYMONDO GROUP younger than 7 years old; or is a person who is not able to take care of himself/herself, Customer shall be a person who take care and assist of such aforementioned person at all times.
• PLAYMONDO GROUP provides the gates at entrance and exit and arrange a separate area for a purpose of accommodating Customer only, therefore, PLAYMONDO GROUP shall not be responsible in case of loss or destruction of your belonging/property; or loss of your child/children notwithstanding if your child/children has been gone with himself/herself or gone with someone else.
• PLAYMONDO GROUP has no duty to follow, monitor or check any person’s behavior while using a service at PLAYMONDO GROUP, however, if PLAYMODO GROUP notices or become aware of any action of any person not follow PLAYMOND GROUP’s rules and suggestions; or considers that any person has no suitable health condition to use a service, PLAYMONDO GROUP will terminate and cancel the service, and shall reserve the right not to refund the service fee to Customer.
• PLAYMONDO GROUP assumes no responsibility at all in case of any person’s death, physical injury or property destruction caused by not following the rule or suggestion; or with intention or negligence of any person.
• Customer agrees to strictly comply with PLAYMONDO GROUP’s rule announced at our facility.
• Customer agrees to assume responsibility and take care of your child/children using a service at PLAYMONDO GROUP’s facility. Customer shall also be responsible of any action of such child/children in case of any death, physical injury or property of any person in PLAYMONDO GROUP’s facility resulting from using service.
• Customer must wear non-slip socks at all time while using a service.
• Customer must have good health condition suitable for using a service and have no contagious disease and sickness such as coughing, sneezing, fever, phlegm, runny nose, cold including any sickness/disease which PLAYMONDO GROUP deems not appropriate to use a service.
• In case Customer gets injured from an accident or any incident while staying in PLAYMONDO GROUP’s facility, Customer entitles PLAYMONDO GROUP to proceed as a person of ordinary prudence deems appropriate in order to assist Customer, including but not limited to inform the hospital, emergency rescue service, governmental officer at Customer’s own cost. Please note that any action of PLAYMODO GROUP in this clause is not for a purpose of providing service, but for humanitarian aid and helping Customer only.
• Customer agrees and confirm that after checking PLAYMOND GROUP’s facility, your child/children has good health condition and readiness for using our indoor playground. Customer must be prudent and check the appropriateness of any playground equipment whether it is suitable for your child/children.
• Customer agrees to waive the right to any claim, file a lawsuit, legal proceeding, compensation against PLAYMONDO GROUP for any loss or damage to your property, body injury, death, family or assignee caused by using a service no matter the cause is done intentionally or negligently by yourself or your child/children. This waive shall also covers to PLAYMONDO GROUP’s affiliates, directors, shareholders, employees, supporter, representatives, business partners or any assignees.
• If Customer wishes to receive any information from PLAYMONDO GROUP, please contact via PLAYMONDO GROUP LINE application, E-mail and SMS
• In order to comply with personal data protection laws, PLAYMONDO GROUP has announced Privacy Policy in order to inform Customer that PLAYMONDO GROUP has collected, used, and disclosed your personal data, you can visit our Privacy Policy at our website: https://playmondo.fastorder.today/data/en/PDPA.html For using a service, you agree to acknowledge our Privacy Policy.
Consent:
Customer gives a consent to PLAYMOND GROUP to record an image and video while using a service at PLAYMONDO GROUP for a purpose of providing a service, safety, advertisement and customer services.
Customer gives a consent to PLAYMONDO GROUP to collect, use and disclose your personal data to PLAYMONDO GROUP’s data processor for a purpose of advertisement, customer services and marketing on PLAYMONDO GROUP’s products or services.
